Provisions relating to the consequences of marriage
(In Nepali Act)
- Considered as husband and wife: If a man and a woman are married, they will be considered as husband and wife of each other as long as such marital relationship continues.
- Relationship and responsibilities of husband and wife:
- There should be mutual love and harmony between husband and wife.
- Unless it is otherwise arranged by mutual agreement, the husband and wife shall live together and establish a family life.
- Husband and wife should support, protect and respect each other.
- Husband’s house shall be considered as the residence: Unless the husband and wife have determined separate residences by mutual agreement, the wife’s residence shall be considered to be in the husband’s house.
- Considered to be each other’s representative: Unless the law provides otherwise or there is a legal dispute between husband and wife, husband or wife shall be considered to be each other’s representative in general household affairs.
- Treating according to dignity, should be arranged: The husband or wife should arrange or arrange for each other to eat according to their dignity and ability and health care.
- Home affairs must be conducted by agreement:
- The husband and wife of a single spouse must conduct household affairs based on mutual agreement according to their property, income and status.
- Husband or wife shall take the consent of each other when selling or transferring property in their name, unless otherwise provided by law.
- Profession, business or work should not be stopped: Husband or wife or any member of the family should not stop each other from doing profession, business or work according to their skills, competence or ability.
- Limitation: A person who is aggrieved by action taken in accordance with this paragraph may file a complaint within three months from the date of action.
