What is Dowry and Law?

Introduction

Such wrong practices have been prevalent in our society for many years. Among these bad practices, taking dowry is also a bad practice. This practice has taken hold of people from all sections of our Nepali society whether they are rich families or poor families. You have caught this practice of all these. Nowadays, we read newspapers and watch news channels and not a day goes by where we do not get to read or watch news related to dowry.

Many laws have been made by the government to prevent this kind of curse in our country. Today we try to know these laws through this article. What is dowry? What is the offense under The Dowry system isn't legal in Nepal. It is a crime to give or take the dowry in marriage in Nepal according to the National Criminal Procedure Code 2017. We get information about some such dowry and laws.

What is dowry?

1.   According to the National Criminal Procedure Code 2017, during marriage, for marriage, before or after marriage or at the time of marriage, any property or thing of value which is directly or indirectly transferred by one party to the other party or to any, the property or valuables given directly or indirectly to the party's parents or any other person is called dowry.

2.   Any gift which is not given in lieu of marriage is not dowry.

3.   Any gift given to a newly wedded bride by her parents as dowry does not come under the definition of dowry.

 

What is the offense under the National Criminal Procedure Code 2017.

Prohibition of transacting property in marriage

No marriage shall be concluded, or caused to be concluded, upon having asked for, or on the condition of receiving or giving of, any type of movable or immovable property, dowry, or any property from the bridegroom or the bride side, except such ordinary gift, donation, money, or one set of jewelry worn on the body as has been practiced in his or her custom.

 

Punishment

A person who commits this crime shall be liable to a sentence of imprisonment for a term not exceeding three years or a fine not exceeding thirty thousand rupees or both sentences.
